Oh, this drivel. R. Schneider made a remarkable butchery of the teshuvas Chasam Sofer.

Strictly speaking, motche's paper is going to be really short:
"There is no concept of copyright in Jewish law."

I don't know whether to consider you arrogant, ignorant, or both.

Consider me both. But first read the teshuvah he quotes and than tell me it says what he says it says. I actually spent a fun-filled four months on motche's project.

I don't have the patience, but I'll take your word on it and trust your judgment. So that just leaves arrogant.

It's a problem.

In a nutshell, the problem is that people don't understand what a copyright is. Copyright is a certain right of ownership which says "what I make is mine." What the Chasam Sofer and others are protecting is not an inherent right in the work, but the publisher's (or in the case of R. Heidenheim, author) investment. This is called "unfair competition."

How's this project coming along?

So, Motcha, does halacha recognize intellectual property? I yes, how? If no, how does halacha address the resulting disincentivitazion in research and development? In other words how do you refute the argument that without intellectual property rights no one will bother to find the cure for cancer?

It's a bit like mayim achroinim vasser. "marah mkomos" makes sense, "mkomos" doesn't.
